When a user chooses a different language, his choice is ignored.

Ex:

• User enters website.com and is shown the english version.
• User clicks a link for the portuguese version that is hosted under the same tld
• The english version is still displayed.

This is a problem because we may host some languages under the same tld and simply open the english version by default.

So for example, you may host English language on a .com domain, a German language on a .de domain and Portuguese also on the .com domain too?

One quick solution would be to use a sub domain for Portuguese and register the language with the sub domain.
for example,

TranslatableDomains::addDomainHandler('mysite.com','en_US');
TranslatableDomains::addDomainHandler('mysite.de','de_DE');
TranslatableDomains::addDomainHandler('pt.mysite.com','pt_BR'); // i think i got the language code right..

I never really anticipated this issue. Thanks for bringing it up.

Maybe a more definite solution could be some session variable in order to know if the user has changed the default language?

Session variables won't go across multiple tld's so that may get very convoluted very quickly so I'd rather not rely on that
