legal: September 2026 privacy policy and terms

Replaces the privacy policy and terms of use with the September 2026 revision, in German and English. German remains authoritative.

Privacy policy

Roughly twice the previous length. New material:

• an explicit separation between the website and the application, including what happens when you use Pelton's AI features (you choose the provider, we are not a controller)
• the full list of technical data a page request produces, and how long it is kept
• a table of third-country recipients with the basis for each transfer
• the reasoning for why audience measurement needs no consent under section 25 TDDDG
• the complete Art. 12 to 22 rights catalogue, with how to exercise each one
• a data security section

Terms of use

Twelve sections become eighteen. New material:

• how the contract is formed, and that no feature, update or fix is promised
• the split between the developers who wrote Pelton and the company that distributes it, and who to direct which claim to
• consumer rights for digital products under sections 327 et seq. BGB
• bundled library licences and where to read them in the app
• the website's own licence
• themes and third-party content, including that gallery review is not an assurance
• the first-run notice, and that dismissing it does not change what applies
• place of jurisdiction

Deviations from the drafted text

Three points in the drafts did not match the project and were corrected. Each is in its own commit:

• the drafts describe the website as MIT-licensed; its LICENSE is GPL-3.0, so the terms now say GPL-3.0
• the drafts state the licence manifest holds 39 entries and records a version and source location per library; it holds 48 and records name, licence and full licence text, so the count and the field list are replaced by what is actually recorded
• contact addresses now point at privacy@pelton.app for data-subject requests and security@pelton.app for vulnerability reports, matching SECURITY.md

Also

• the download version and the changelog were still showing 2026.4 from 4 September. Both now reflect 2026.4.4, and the changelog gains the missing 2026.4.1 through 2026.4.4 entries.
• a scrollable table style for the transfer table, so the page still fits a phone
